This is my personal, "non US reader", view on the Service Agreements for
SMB consultants book.
I've found this book to be an extremely interesting read, and it really
does a lot more than advising the reader in setting up the agreements as
boldly mentioned in the title. Besides going through these different
agreements and contracts, the book really is a quick start, blueprint
guide to the chores of legally and fiscally setting up a business in IT
SMB consultancy, and an invaluable little guide in doing so.
Obviously the legislation and tax systems in the US differ from most
countries in the world, but the basic principles remain the same.
Whether you are located in the US or anyplace else, you'll still need to
run any kind of agreement by a local lawyer or legal expert to check if
everything applies to your specific area/state/country.
The different business types/corporation types mentioned, are used in
most (capitalist) countries I know of, no matter what title they are
given, LLP, SA, BV.
And unless you live in Monaco, taxes are something we all have to deal
with..
If I project this on our own situation, we too had to change from being
a Dutch VOF (partnership) to a BV (LLC), to cope with our growth in
clients and potential risks involved in liabilities.
As the author mentions, no, hammers into us, in any possible way, this
book is not meant as a quick way of getting yourself a bunch of
pre-drafted contracts and agreements, but rather a step by step guide in
the drafting of these contracts and the pitfalls they might contain.
In just under 200 pages, the book takes you from identifying where you
are at present, considering this, guiding you through the issues most
(tech-backgrounded business owners) haven't really worked out to the
fullest extent, to the contracts themselves and finishes with tips and
guidelines on making you aware of where to go from here.
This all consists of pure, hard-earned, from the trenches info that is
of value to each of us, anywhere in the world.
So, yes, it is a great source of info for the non-US based readers like
myself..
